ARTICLE 2 - SUBJECT


The subject of this Agreement is the sale and delivery of the product/products that the CUSTOMER orders electronically from the website muulegacy.com, with the code, name, quantity, and sales price indicated on the invoice as specified in Article 3. The rights and obligations of the parties are determined in accordance with the Law No. 6502 on Consumer Protection, published in the Official Gazette on 06.10.2023, and the Distance Contracts Regulation.


ARTICLE 3 - DETERMINATION OF THE PRODUCT, PAYMENT, AND DELIVERY TERMS


3.1 PRODUCTS

The basic features of goods or services are listed on muulegacy.com. The prices of the products and services listed on the website are valid until updated or changed. Temporarily listed prices are valid until the specified time ends. The sales price of the goods or services includes all taxes, as shown on the website.

After the products ordered are supplied by lucentie, delivery will begin within 3-5 business days depending on the category of the product. All orders on the website are shipped free of charge, with the shipping fee covered by the SELLER.


3.3 LATE PAYMENT INTEREST

Payments for the products will be made either in advance or by credit card. Therefore, no late payment interest will be applied by the SELLER.


ARTICLE 4 - GENERAL TERMS


4.1 The CUSTOMER declares that they have read the preliminary information on the website, including the basic characteristics of the product, the sales price including all taxes, payment methods, the delivery time and costs to be borne by the BUYER, and the SELLER’s commercial name, address, and contact information, and confirms this electronically.


4.2 The product or service subject to this Agreement will be delivered to the CUSTOMER or the person/entity specified by the CUSTOMER within the period indicated on the website, based on the distance from the CUSTOMER’s residence, and within a legal period of 30 days.


4.3 If the product is to be delivered to someone other than the BUYER, the SELLER is not responsible for the non-acceptance of the delivery by the recipient.


4.4 The SELLER is not responsible for any issues arising during delivery, such as the product not being delivered to the CUSTOMER due to issues encountered by the courier company. The SELLER is considered to have fully and properly fulfilled its obligations, even if the CUSTOMER is not present at the delivery address.


4.5 If the payment is made by credit card, the CUSTOMER is responsible for any legal risks, such as unauthorized or fraudulent use of the credit card.


4.6 In case of a repair request for the product, the timeframes specified in the Consumer Law and related regulations will apply.


4.7 The SELLER, with a valid reason, may provide the CUSTOMER with a different product of equal quality and price before the performance period of this Agreement expires.


4.8 In case of force majeure or extraordinary conditions such as weather disruptions or transportation problems, the SELLER is obliged to notify the CUSTOMER. The CUSTOMER may choose to cancel the order, accept a similar product, or wait for the delivery to be delayed.


4.9 The SELLER reserves the right to change the shipping carrier without informing the CUSTOMER.


4.10 In the event that the product has been delivered and the payment method used by the CUSTOMER (such as credit card, debit card, etc.) is used fraudulently, the product must be returned to the SELLER within 3 days. The shipping costs are borne by the CUSTOMER.


4.11 Once the package is received, it is deemed that the delivery company has fulfilled its duty properly. Damaged packages should not be accepted and a report should be made.


ARTICLE 5 - PAYMENT AND REFUND PROCEDURE


5.1 If the CUSTOMER exercises the right of withdrawal or if the product cannot be supplied or a refund is decided by an arbitration board, the SELLER will return the full amount to the CUSTOMER within 14 days. The refund will be processed according to the payment method used.


5.2 Products to be returned or exchanged should be sent back in a separate package, ensuring that they are not damaged during shipment. Products with damaged packaging or labels cannot be returned or exchanged.


ARTICLE 6 - RIGHT OF WITHDRAWAL


6.1 The consumer has the right to withdraw from the contract within 14 days from the delivery date, without providing any reason. However, some products, such as those made to order, cannot be returned. This is clearly stated on the product detail pages.


6.2 To exercise the right of withdrawal, the CUSTOMER must notify the SELLER within the 14-day period by fax, phone, or email and ensure that the product is unused and in accordance with the terms of the Distance Sales Agreement.


6.3 Returned products must be delivered in their original boxes, with no damage.


6.4 To exercise the right of withdrawal, the CUSTOMER must return the product with a cargo delivery receipt and the original invoice.


ARTICLE 7 - PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED


The consumer cannot exercise the right of withdrawal for the following types of contracts:


a) Products or services whose price fluctuates based on financial market changes that are not under the control of the seller.


b) Products tailored to the customer’s personal needs.


c) Perishable goods or items with a short shelf life.


d) Products whose packaging, seal, or protective elements are opened and cannot be returned for health and hygiene reasons.


e) Products that are mixed with other goods after delivery, making them impossible to separate.


f) Periodicals such as newspapers and magazines.


g) Contracts for services that must be performed on specific dates or within a specific period (e.g., accommodation, transportation, food supply, entertainment services).


h) Services provided electronically or intangible goods delivered immediately.


ARTICLE 8 - COMPETENT COURT


In case of disputes arising from the implementation of this Agreement, Turkish law will apply, and the courts of Istanbul (Central) and Enforcement Offices will have jurisdiction.


This Agreement has been read, accepted, and confirmed electronically by both parties. In matters not covered by this Agreement, the provisions of the Law No. 6502 on Consumer Protection and related regulations shall apply.
